Requirement for licensing ART practices and or storage facilities

Licensing of private assisted reproductive technology (ART) practices and or storage facilities is based on government legislation, the Human Reproductive Technology Act 1991 (the Act) and Surrogacy Act 2008 (external site).

You need to apply for a licence if you wish to operate a private assisted reproductive technology practice and or storage facility as defined by the Act.

The Human Reproductive Technology Act 1991, Part 4 Section 2-3 states:

A “storage licence” may authorise the licensee to carry out any procedure related to – (a) the storage of –

  1. any human egg intended for use in an in vitro fertilisation procedure; or
  2. any human embryo; or
  3. any human egg undergoing fertilisation;

and

(b) the keeping of human sperm, having been obtained from different men; and

(c) any project of research related to such storage and approved under section 20 of the Act

A “practice licence” may authorise the licensee to carry out any artificial fertilisation procedure, not being a storage procedure, and any project of research approved under section 20 of the Act.

Licensing fees 2023-24

Application for a licence

Fees are payable at the time of an application for a licence. The fee comprises of:

  • A practice licence has a fee: $1,699
  • A storage licence has a fee: $1,062
  • Combined practice and storage licence has a fee: $2,761.

Renewal of licence

An annual renewal fee is as follows:

  • $1,746 for a practice licence renewal
  • $1,084 for a storage licence renewal

How to pay for your licence

An invoice will be submitted to the applicant via email. You can then pay your licence online (external site) using the convenient and secure BPOINT payment system. Payments can be made anytime online using a MasterCard or Visa credit card.
