Licensing assessment process for private assisted reproductive technology (ART) practices and or storage facilities

What does a licence include?

An application for a licence is based on the suitability of the:

  • licence applicant (licensee)
  • premises for the purpose
  • arrangements for management, staffing, equipment and support services

You will need to complete an application form with a declaration to verify your application.

The Director General of the Department of Health must be satisfied you are able to meet all of the above requirements before you can be granted a licence for your assisted reproductive technology practice and or storage facility.

Functional brief

The functional brief must be provided with your application and should include information on the services to be offered.

You will need to include information on the level of function, for example:

  • its geographical location
  • referral mechanism
  • hours of operation
  • the type/s of services/procedures that will be carried out, support services, workforce and the policies and procedures that will be in place to ensure safe practice.

Suitability of the licence applicant

The licence applicant must demonstrate to the CEO of the Department of Health that they meet the minimum requirements used to assess the suitability of a licence holder. 

The licence applicant/licence holder must be eligible to apply for or maintain a licence under the Human Reproductive Technology Act 1991.

Licence applicant must at a minimum demonstrate the following

  • Identity: licence applicant/persons must have attained 18 years and if the licence holder is a sole trader, body corporate, company, partnership or a firm
  • Character and reputation: the licence applicant must demonstrate that have not been convicted of an offence that would render them unsuitable to hold a licence, provide evidence they are trustworthiness and honesty
  • Material and financial resources: the licence applicant must demonstrate evidence of sufficient material and financial resources to conduct a licensed private ART Practice and or Storage facility which is the subject of this licence application. The licence applicant must demonstrate evidence of insurance and indemnity that is reasonably appropriate to the licensed health facility which is the subject of this licence application.
  • Competency: The licence applicant must demonstrate that they posses the competency to conduct a privately licensed ART Practice and or Storage facility, including operational management, qualifications, skills and appropriate equipment.

Suitability of premises

The licence applicant must allow the Department of Health consultants to assess the suitability of the premises against a set of standards and including the current version of the National Construction Code (NCC).

Suitability of the arrangements for management, staffing and equipment

The licence applicant must provide information in accordance with the Human Reproductive Technology Act 1991 and the Human Reproduction Technology Directions 2021
