Public Health Act – approved forms

Under the Public Health Act 2016 (Public Health Act), the Chief Health Officer has approved the following forms.

Individuals acting on behalf of an enforcement agency in administering the Public Health Act are granted permission to use the below approved forms.

As enforcement agencies, local governments can make non-substantive/stylistic changes to these approved forms (e.g. addition of local government logo).  

Approved forms

Forms Provision Purpose
Improvement notice (PDF 853KB)  Section 212 of the Public Health Act 2016 (WA) An improvement notice is a form that requires or prohibits a person from undertaking a specified action.
Notice of compliance (1.6MB)  Section 215(1) of the Public Health Act 2016 (WA) A notice issued by an enforcement agency confirming that the recipient of the improvement notice has complied with that notice.
Notice of non-compliance – improvement notice (744KB)  Section 215(2) of the Public Health Act 2016 (WA) A notice issued by an enforcement agency advising that the recipient of the improvement notice has not complied with that notice.
Enforcement order (811KB)  Section 216(1) of the Public Health Act 2016 (WA) An enforcement order is a form that requires or prohibits a person from undertaking a specified action. Failure to comply with an enforcement order has significant penalties. When a person has not complied with an enforcement order, an enforcement agency may take any action necessary to implement the order and recover any costs.
Certificate of clearance (PDF 716KB)  Section 223 of the Public Health Act 2016 (WA) A notice issued by an enforcement agency confirming that the recipient of the enforcement order has complied with that order.
Notice of non-compliance – enforcement order (PDF 784KB)  Section 224(3) of the Public Health Act 2016 (WA) A notice issued by an enforcement agency advising that the recipient of the enforcement order has not complied with the order.
